Dec. 3222 (BIA 1990) Immigration Judge Robert Brown granted Fidel Armando Toboso-Alfonso's application for withholding of deportation to Cuba on February 3, 1986. Judge Brown concluded that Toboso was a member of a particular social group (homosexuals) who feared persecution by the Cuban Government. On March 12, 1990 the Board of Immigration Appeals upheld the decision. On June 16, 1994 Attorney General Reno ordered this decision to be a legal precedent.
