Nuevas Asociaciones siguen formandose: En las ultimas asambleas generales del Comite para la Consolidacion del Movimiento Costarricense Pro-Respeto de la Identidad Sexual y Enfermos de SIDA se han formado dos grupos para iniciar el trabajo en comisiones para estructurar las nuevas asociaciones. La decision de separar el movimiento en dos asociaciones (una asociacion exclusivamente encargado de toda la problematica de HIV y SIDA, y otra asociacion para el trabajo politico) fue tomada democraticamente despues de discutir los aspectos positivos y negativos de la separacion en las asambleas. Las asociaciones comenzaron con el trabajo en comisiones para definir las actividades y para darlas una estructura y constitucion legal. Para mantener el contacto dentro de las asociaciones se han formado una comision especial de comunicacion. La asociacion encargada de la problematica de HIV y SIDA solicitara lo mas pronto posible la inscripcion legal para obtener la posibilidad de recibir donaciones. Las asociaciones affirmaron otra vez que el trabajo dentro de las mismas sera hecho por voluntarios (excepciones solo en caso de contratar psicologos y/o enfermeras/os para la atencion de gente con HIV y SIDA) -------------------------- 2. Lucha contra la discrminacion de gente g/l/b/t El "Magnus Hirschfeld Center for Human Rights" (Centro Magnus Hirschfeld de Derechos Humanos) ha publicado el siguiente informacion a la prensa el dia 10 de Sept. 1995: Informacion a la Prensa Las autoridades de Costa Rica estan denunciadas por ofensas contra los Derechos Humanos por la minoria homosexual. El gobierno de Costa Rica esta denunciado poe una serie de violaciones de los Derechos Humanos por la falta de forzar la proteccion de los Derechos Humanos en caso de la minoria homosexual afectada de este pais. Una peticion fue enviado hoy por el Centro Magnus Hirschfeld de Derechos Humanos, un grupo internacional de abogados de Derechos Humanos con sede en New Jersey, con la Comision Interamericana de Derechos Humanos, una agencia official de la Organizacion de los Estatos de America (OEA) encargada con la imposicion de la Convencion Americana de Derechos Humanos, un acuerdo internacional dentro de estatos del hemisferio del oeste de lo cual Costa Rica forma parte. El Sr. William Courson, el Director Ejecutivo del Centro afirmo que la peticion fue enviado por : "muchas acciones que pasaron dentro de los ultimos dos anos, los cuales tomados juntos indican un esquema peligroso dessarrollandose en Costa Rica. Mientras tanto el registro Costarricense de Derechos Humanos es exemplar, parece que al menos con respecto al las comunidades gay/lesbicas del pais esta situacion esta empeorandose. En 1993 una universidad en San Jose anuncio publicamente que no aceptaria estudiantes homosexuales o facultades dentro de la institucion, y que los que ya estan dentro de la institucion serian excluidos o despedidos; ignorando llamdas internationales de accion el Gobierno no tomo ninguna accion. Durante de los dos ultimos anos numerosos sucesos de alborotes policiales contra gente y grupos gay/lesbicos pasaron sin alguna intervencion de las autoridades. Hace algunos meses el Gobierno de Costa Rica rechazo el reconocimiento legal de un grupo gay de Derechos Humanos, y aunque esta decision fue revocado mas tarde, la amenaza de una confrontacion internacional fue necesario para forzar este cambio de opinion. Hace poco periodicos Costaricenses lanzaron reportajes en los cuales llamaron por un 'pogromo' contra ciudadanos homosexuales apoyado por el Estado. Y aunque esta llamada estuvo en contra de las obligaciones legales nacionales e internacionales el Gobierno de Costa Rica se mantuvo callado. Uno puedo solamente sospechar que elementos reaccionarios dentro de la sociedad Costarricense, lo mas anotable la jejarquia de la Iglesia Catolica Romana en este pais, estan envolugrados en la itencion de subvertir el respeto historico de Costa Rica a los Derechos del individuo." Como establecido dentro de las normas de la OEA, la Comision de Derechos Humanos se referira en este asunto al gobierno cargado con las violaciones para un intercambio de opiniones para tomar consideraciones formales para determinar la gravedad de la denuncia y la posible admision de la misma. Decisiones de la Comision de Derechos Humanos (y su institucion apelada, la Corte Interamericana de Derechos Humanos con sede en San Jose / Costa Rica) tienen un caracter obligatorio y la fuerza de una lei. ======== La carta del Magnus Hirschfeld Center fue accompagnada por la peticion al la Comision Interamericana de Derechos Humans / Washington demonstrando en forma detallida los articulos violados por la pasividad del Gobierno de Costa Rica. Copias fueron enviados a: Ministro de Relaciones Exteriores de Costa Rica, ai, IGLHRC, ILGA y muestro Comite. Saludos cordiales Harald +++++++++++++++++++ ENGLISH: --------------- 1.New Associations on their way During the last general meetings held by the Committee for the Founding of the Costarican Movement Pro-Respect of Sexual Identity and People with HIV and AIDS two groups were formed to elaborate the futures structure and aims of each association. The decision to separate the movement into two associations was taken democratically during the meetings after discussing the pros and contras of a separation. One association will be dedicated exclusively to all HIV and AIDS issues. The other one will be dedicated to the political work. The associations have formed commissions in order to define activities, the legal structure and its constitution. To guaranty the communication between the two groups a special commission was formed. The association dedicated to HIV/AIDS issues will as soon as possible apply for the legal inscription for being able to accept donations. The associations confirmed again that their work will be made by volunteers (only exception: contracts with psychologists and nurses to attend people with HIV/AIDS). -------------------- 2. Fight against g/l/b/t discrimination The "Magnus Hirschfeld Center for Human Rights" published on September 10 the following press release: PRESS RELEASE Subject: Costa Rica Authorities charged with human rights offenses by homosexual minority The government of Costa Rica has been charged with a serious of human rights breaches on account of its failure to enforce human rights protections as they effect that country's homosexual minority. A complaint was filed today by the Magnus Hirschfeld Center for Human Rights, a New Jersey - based international human rights advocacy group, with the Inter-American Commission on Human Rights, an official agency of the Organization of American States (OAS) charged with the enforcement of the American Convention on Human Rights, an international agreement among western hemisphere states to which Costa Rica is a party. William Courson, the Center's Executive Director stated that the complaint was filed in the wake of: "a number of actions taking place over the past two years, which taken together betoken an ominous pattern emerging in Costa Rica. While until recently Costa Rica's human rights record is exemplary, it appears that with respect at least to the country's gay and lesbian communities that standard is deteriorating. In 1993, a University in San Jose announced publically that it would refuse to accept in its ranks homosexual students and faculty, and expel or fire those already affiliated with the institution; in spite of international calls for action, the government took no action whatsoever. Over the past two years, numerous incidents of police harassment of gay and lesbian people and groups have taken place and left unaddressed by the authorities. Several month ago, Costa Rica's government refused legal recognition to a gay human rights group, and although this decision was later reversed by the government, it required the threat of an international confrontation to bring such an end about. Earlier this year, Costa Rican newspapers launched what amounted to a call for a states-sponsored "pogrom" against homosexual citizens, and in spite of its domestic and international legal obligations, Costa Rica's government has remained silent. One can only suspect the involvement of reactionary elements in Costa Rica society, most notably the Roman Catholic hierarchy in that country, of attempting to subvert Costa Rica's historic; respect for the rights of the individual." Under the procedure established by the OAS, the Human Rights Commission will refer the matter t the government charged with violations for an exchange of views prior to undertaking formal consideration to determine the complaint's substance and admissibility. Decisions of the Human Rights Commission (and it's appellate body, the Inter-American Court of Human Rights which is located in San Jose, Costa Rica) are of an obligatory character and have the force of law. +++++++++++++ Attached to the press release we received the complaint to the Inter-American Commission on Human Rights with detailed descriptions which articles were violated by the passivity of the Costa Rican Government.
