Texas Supreme Court Retains Sodomy Law Dallas, TX (EGCM) The Texas Supreme Court has made a ruling that in effect retains the state's sodomy law. The 5 to 4 ruling reverses a lower court ruling that declared the statute against homosexual sodomy unconstitutional. The Texas Supreme Court bypassing the issue of the constitutionality of the state's sodomy law, said that neither it nor the lower courts that had barred enforcement of the law had jurisdiction to declare it unconstitutional. "The notion that government can in many states regulate sexual relations in the privacy of one's home is repugnant to most Americans," said Martin Hiraga, Director of the National Gay & Lesbian Task Force Privacy Project. "The Texas Supreme Court has passed over an opportunity to change a ludicrous law which fosters an environment of hatred, bigotry, and discrimination in Texas towards gay men and lesbians." Sixteen states currently have laws prohibiting heterosexual and homosexual sodomy. Seven states, of which Texas is one, have laws that only prohibit homosexual sodomy.
