Date: Wed, 6 Jul 1994 15:58:17 EDT [ Send all responses to KSSHC@CUNYVM.cuny.edu only ] The July 2, 1994 Cincinnati Post reported that Ohio Attornety General Lee Fisher filed a court brief on the side of the Equality Foundation, opposing Cincinnati's anti-LGB Issue 3. "In the State's brief, Fisher contends that measures adopted by the people of Ohio must be consistent with the provisions of the U. S. Constitution. Issue 3 suporters have contended that the Consititution provides that a vote of the people is the final authority. Fisher's brief said Issue 3 ... violates the equal protection clause of the Constitution because it prevents a class of people from seeking legal protec- tion from the legislative body on an equal basis with other citizens. [He also said "this case involves a direct effort to undermine the fight against dis- crimination" and threatened to limit the scope and application of state hate crime laws. -- KS] Issue 3 Supporters contend homosexuals, lesbians and bi-sexuals [CP punctua- tion] do not constitute a class of people entitled to civil rights protections, such as African-Americans" Thanks to Art Leonard for passing the CP article on.
