Ben Cayetano's decision to nominate civil rights attorney Dan Foley to the Hawai`i Intermediate Court of Appeals was an interesting — one might say courageous — choice. There's no doubt about Foley's legal credentials or ability. But through his civil rights work, he has been associated with a number of high-profile, politically controversial cases. The most obvious, of course, was the so-called "gay marriage" case that he successfully pursued in the Supreme and Circuit courts. The legal victory was politically unpopular and was quickly overturned by the Legislature and later by the voters through a constitutional amendment. Ben Cayetano to the four-member Intermediate Court of Appeals, the state's second-highest court. Cayetano named Foley to fill the vacancy left this year by the governor's appointment of Simeon Acoba to the state's highest court, the Hawai`i Supreme Court. "Dan Foley is undoubtedly one of the state's top attorneys on constitutional law," the governor said. "He has a reputation for integrity, and his stand on legal issues, regardless of whether politically popular or not, speaks volumes of the courage and commitment he will bring to the Intermediate Court of Appeals." Box 3080 Honolulu, Hawai`i 96802 mailto:letters@starbulletin.com July 27, 2000 DAN FOLEY IS NAMED INTERMEDIATE COURT JUDGE Foley lead the legal attempt to establish gay marriage in the isles By Associated Press Civil rights attorney Dan Foley, the lead attorney for three gay couples seeking the legal right to marry in Hawaii, was named today to the Intermediate Court of Appeals by Gov. Ben Cayetano. The appointment must be confirmed by the Senate. Foley would replace Simeon Acoba, who was elevated to the state Supreme Court. Foley represented two homosexual male couples and one lesbian couple who sued the state because they couldn't get legally married.
