NO. 36 NINETENTH LEGISLATURE. 1997 STATE OF HAWAI`I A BILL FOR AN ACT PROPOSING AN AMENDMENT TO ARTICLE I, SECTICN 5, OF THE CONSTITUTION OF THE STATE OF HAWAI`I TO AMEND THE DUE PROCESS AND EQUAL PROTECTION CLAUSE. BE IT ENACETED BY THE LEGISLATURE OF THE STATE OF HAWAI`I 1 SECTION 1. The purpose of this Act is to propose an 2 amendutent to article I, section 5, of the Constitution of the 3 State of Hawai`i to clarify that same sex marriages are not 4 constitutionally protected and to define marriage as a legal 5 relationshlp between a male and a female. 6 SECTION 2. Article I, section 5, of the Constitution of the 7 State of Hawai`i is amended to read as follows: 8 "DUE PROCESS AND EQUAL PROTECTION 9 Section 5. No person shall be deprived of life, liberty or lO property without due process of law, nor be denied the equal li protection of the laws, nor be denied the enjoyment of the 12 person's civil rights or be discriminated against in the exercise 13 thereof because of race, religion, sex or ancestry. 14 Nothing in this section or any other section of this 15 constitution shall be interpreted to create a constitutional 16 right to marriage between two people of the same gender. 17 Marriage is reserved as a legal relationship that has been 18 sanctioned by the State between a man and a woman as husband and Page 2 S.B.
