All the supplemental briefs on the Baehr case are now on the web, at We especially recommend the plaintiffs brief (written by Dan Foley, Evan Wolfson, and Kirk Cashmere) and the ACLU brief (largely written by Matt Coles). The supplemental reply brief from the state was filed February 1, and is also on the web. It is written by Charles Cooper, a DC lawyer hired by Hawaii to fight the Baehr case. Cooper's firm just won a major victory in the US Supreme Court concerning the new national census: Cooper's firm successfully argued for the good old ways of (mis)counting people. Obviously, a tough opponent. In the supplemental reply brief he casually dismisses the only official communications from the State to the voters as to what the amendment meant. Proof by intimidation?
