    departmental policies regarding homosexuals. The amendment would
    also reinstate any person removed for such reasons prior to the

    amendment to the Smith, R-N.H., amendment to prohibit agencies
    receiving money under the bill from encouraging or supporting
    homosexuality as a positive lifestyle alternative. The Smith
    amendment was essentially the same as the Helms. Adopted 63-36:

    ** 1994 CQ SENATE VOTE 250 ** S1513. Elementary and Secondary
    Education Reauthorization - Homosexual Lifestyle. Smith, R-N.H.,
    amendment, as amended, to prohibit agencies receiving money
    under the bill from encouraging or supporting homosexuality as a
    positive lifestyle alternative. Before being adopted the Smith
    amendment was amended by a similar protecting Helms, R-N.C.
    amendment (See vote 244) and by two Kennedy, D-Mass.,
    amendments. The first Kennedy amendment would prohibit money in
    the bill from being spent to promote or encourage sexual
    activity (See vote 246), and the second amendment, adopted by
    voice vote, would prohibit money in the bill from being used to
    distribute condoms in public schools unless the programs met
    certain local control criteria. Adopted 91-9: R 41-3; D 50-6 (ND
    36-6, SD 14-0), Aug. 2, 1994.
