Box 1281, Ft.Lauderdale, FL 33302 ***************************************************************** April 10, 1996 Letters to the Editor USA Today - Editors@usatoday.com VIRGINIA'S 4TH U.S.COURT OF APPEALS CONDONES PERSECUTION OF GAYS Your report on the 9-4 ruling against Navy Lt. Paul Thomasson by Virginia's 4th U.S. Circuit Court of Appeals on Friday again revives the pain of the intolerant persecution, imprisonment and execution of gays in Nazi Germany before the end of WWII. That "inquisition" lingers. Painfully, by blessing "don't ask- don't tell," the Circuit Court likewise sanctioned the actions of US allied forces immediately after the surrender and during the period of European occupation. They opened the death camp doors, freed those incarcerated but, without a tear of remorse, closed those same steel doors on the frozen faces of gays because they were considered criminals of sexual orientation not tortured, maimed and butchered Holocaust victims. Each Judge who ruled "that the judicial power does not reach certain military decisions" has foolishly bankrupted the morality of the Golden Rule for which no scale of blind justice condones nor tolerates especially when justice is wielded by a warrior sword in fear, intolerance and hate. Nine "black robes" said no to Lt.Thomasson and to all those who have died and have been persecuted because of their sexual orientation. They have thereby accepted and subsequently condoned the fact that the Rand Report was concealed from the American people and their elected officials by some of the same types of military officials who continue their codified witch-hunts against a persecuted minority. Ironically the "nein" Virginia "Black Robes" and Pat Robertson's supportive American Center for Law and Justice in Virginia shall be remembered and eventually judged as those who hid from the truth when they resisted and ruled against humanity. The Court has failed in the safeguarding of Constitutional power entrusted to them and they have opted to turn a blind eye and deaf ear to the inquisition leveled against "gays in the military" under the purge of "don't ask-don't tell." There shall be no "Free Speech" in America as long as "Don't tell" gags the truth and there shall be no "Freedom of Religion" as long as "Freedom from Religious Persecution" is shamefully denied.
