EXCERPTS OF THE C. DIXON OSBURN, ESQ. MEMO TO THE SECRETARY OF THE
AIR FORCE:

....."Indeed, the Department of Defense does not prosecute heterosexual
servicemenbers for similar allegations........given the mandate of the
Department of Defense Instruction 5505 that requires even-handed
enforcement of regulations governing consensual, private, adult sexual
conduct."

..... "On two occasions, the special agent attempted to coerce the civilian
into signing a prepared written statement against Capt. Dinges that was
filled with factual inaccuracies."

.... "The civilian is understandably shocked that the military would
harass American civilians about their private, sexual conduct and threaten
them with imprisonment in civilian courts........"

..... "Captain Dinges is currently serving five months in jail at Ft.
Leavenworth...... This is obviously an unacceptable situation..."

....." No one should be in prison for consensual, private, adult, sexual
conduct...... Further, I ask that you instruct all appropriate military
personnel regarding the evenhanded enforcement of the regulations regarding
consensual, private, adult, sexual conduct cited above."
