The constitutional amendment that overturned marriage equality passed by a 52-to-48 percent margin on November 4th. The lawsuits ask the same Court that ruled 4-to-3 to open civil marriage to same-gender couples to invalidate the measure. They argue that the state constitution’s equal protection provisions do not allow a simple majority to revoke the rights of a targeted minority.
