Instead of denying him the license, the City of Toronto referred the question to the courts, asking for clarification on whether gay & lesbian couples should be allowed to marry. That sent queer & government lawyers, activists, and lobby groups scrambling to prepare their arguments, as more couples quickly joined the list of plaintiffs. Using a strategy from Canadian common law, the queer-affirming Metropolitan Community Church of Toronto came on board by announcing the traditional "banns of marriage" for two couples, and submitting licenses to the provincial Registrar-General. A hearing was held last November, and on July 12th the plaintiffs went to the Ontario Superior Court for a day as full of expectations as the day they took their vows.
