It was the culmination of a 7-year legal battle by Delwin Vriend, who lost his teaching position at a Christian college in Edmonton because he is gay. Since sexual orientation was not included as a protected category under Albertan law, his attempt to file a complaint with the Human Rights Commission was rejected. The high court`s strongly-worded unanimous ruling said such exclusion "demeans the individual and strengthens and perpetuates the view that gays and lesbians are less worthy of protection as individuals in Canada`s society. The potential harm to the dignity and perceived worth of gay and lesbian individuals constitutes a particularly cruel form of discrimination." This Way Out`s LUCIA CHAPPELLE details the significance of the ruling, with comments by JOHN FISHER of Equality for Gays And Lesbians Everwhere (EGALE), ROY BEYER of the Canadian Family Action Coalition, MURRAY BILLET of Edmonton`s Gay And Lesbian Awareness Society (GALA), Alberta Premier RALPH KLEIN, and the victorious DELWIN VRIEND (brief intro/outro music from "O Canada") ................................. 5:45 SEGMENT #3 - "TWO" I.D. by veteran activist/writer Urvashi Vaid [:20] + While Canada`s high court was preparing its historic ruling on lesbigay rights this week, the U.S. Supreme Court was hearing arguments about whether government funding of the arts should be determined by, as Congress ordered in 1990, "general standards of decency and respect for the diverse beliefs and values of the American public." The case involves the so-called "NEA 4", four performance artists who had been approved for National Endowment for the Arts grants in 1992, only to have their funding withdrawn under that Congressional "decency" provision. Perhaps not coincidentally, 3 of the 4 artists -- Tim Miller, Holly Hughes, and John Fleck -- are gay or lesbian, and the fourth, Karen Finley, drew fire from Senator Jesse Helms, among others, for her chocolate nude scene depicting abuse of women. At the heart of the matter are the free speech provisions of the First Amendment, and what constitutes "indecent" art.
