This was a donor insemination baby that was jointly planned for by the co-parents; then when the child was five years old the biological mother terminated the relationship and later excluded her former partner from any contact with the child. The court, basically overruling its negative precedent on this same issue from 1991, split 4-3 in holding that the co-parent can proceed with the case, invoking the equitable powers of the court to make a decision in the best interest of the child.
