---------- begin inclusion ------------ TO: All U.S. Employees FROM: Mark Hoffman RE: Company Policies Regarding Spousal Equivalents Many of our employees are members of households of people who are committed to and financially responsible for each other. While many of these households are traditional families, many others are less traditional but just as significant to the individuals involved. In recognition of this fact, Sybase believes a more inclusive definition of "family" is appropriate for purposes of providing certain employee benefits. Therefore, effective immediately, the following Sybase U.S. personnel policies which refer to employee families are extended to include legally declared unmarried spousal equivalents: relocation assistance, family leaves and bereavement leaves. Additionally, effective January 1, 1993, Sybase will make health benefits (i.e. medical, dental, vision, employee assistance) available to unmarried spousal equivalents who sign a legal declaration of spousal equivalency and select dependent health coverage. These changes have important financial and other advantages for employees with non-traditional spousal relationships. The improvements provide further flexibility to the Nautilus benefits program introduced earlier this year and demonstrate a strong belief that a diverse workforce is important to the continued success of Sybase. Revised policies reflecting this statement of philosophy and more detailed information are targeted for distribution within the next 60 days as part of our annual benefits open enrollment period and a general update to our policies and procedures manual. The "Declaration of Spousal Equivalency" states that the two individuals are: unmarried; each other's sole spousal equivalent and intend to remain so indefinitely; at least age 18; not related by blood; residing together at the same residence and intend to do indefinitely; jointly responsible for each other's common welfare and financial obligations.
